Refund Policy

Website Design Services:

Refund Policy

• Deposit: A non-refundable deposit of 40% of the total project cost is due upon signing the contract to secure the project start date and cover initial design work.

• Milestone 2: Website Development: A payment of 40% of the total project cost is required at the beginning of the development stage after initial design and branding work is completed.  Usually within two weeks of the project start date. 

• Milestone 3 – Content Integration: A payment of 30% of the total project is required at the beginning of the content integration stage. Note that if I am writing content for your website, the content portion of the invoice is a separate fee that must be paid in full before content is written or added to the site.  This payment usually falls within six weeks of the project start date. 
  
  
• Milestone 4: Site launch. A final payment of 10% of the total project cost is required before the site is launched on the client’s server, or before passwords are provided if launched on my server. This payment usually falls within eight weeks of the initial project start date, 
  
  

• Cancellation by Client:

  • A refund of 95% will be provided to the client if the project is canceled within 3 business days after paying the invoice.
  • Before Design Approval: If the client cancels before the initial design concept is approved, the deposit is forfeited to compensate for the time and resources invested.
  • After Design Approval: If the client cancels after design approval but before project completion, a partial refund may be issued, deducting the cost of work completed up to that point. The exact amount will be determined on a case-by-case basis.
    
    

• Cancellation by Designer: In the unlikely event that the designer is unable to start or complete the project due to unforeseen circumstances, a full refund of the deposit will be issued to the client within 12 weeks of the start date of the project. 

• Non-Delivery: If the designer fails to deliver the final website within the agreed-upon timeframe and is not responsive to communication attempts for 45 days, the client may be entitled to a full refund, including the deposit.

• Dispute Resolution: In the event of a dispute, both parties agree to seek a mutually agreeable resolution through negotiation or mediation. If no resolution can be reached, the matter may be subject to legal action.

Consulting Services:

Payments for consulting services must be made in advance. Due to the quick turnaround time of the project and the nature of the amount of initial research and scheduling, no refunds are provided for consulting services. 

Project-Based Services

• Initial Payment/Deposit: A non-refundable deposit of 50% of the total project cost is due upon signing the contract to secure the project start date and cover initial work.
• Cancellation by Client:
  
  • Before Project Start: If the client cancels before the project officially starts, the deposit is forfeited to compensate for time and resources invested in project preparation.
  • During Project: If the client cancels after the project has started, a partial refund may be issued based on the percentage of work completed. The specific amount will be determined by deducting costs incurred and a reasonable fee for the services rendered up to that point.
• Cancellation by Consultant: In the rare event that the consultant cannot complete the project due to unforeseen circumstances, a prorated refund will be issued based on the percentage of work remaining.

Courses and Digital Products:

Due to the nature of the immediate access to all digital products or online courses, no refunds are provided after purchase.  If you are unsatisfied with your purchase, for any reason, please contact me at [email protected] to discuss how I can better serve you. If you choose to move forward with one-to-one coaching, you will receive credit for 50% of the purchase price for the course or online product purchased. 

Intellectual Property

The content on JodiBourne.com, including text, graphics, logos, images, as well as the compilation thereof is the property of Bourne Texan Consulting, LLC or its suppliers or clients and is protected by copyright and intellectual property laws. You may not use such content without express written permission from us.

Limitation of Liability

Bourne Texan Consulting, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of, or the inability to use, our website or services.

Changes to Terms and Conditions

We reserve the right to modify these terms and conditions at any time, so please review them frequently. Changes and clarifications will take effect immediately upon their posting on the website.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the state of Texas, USA. Any disputes will be resolved in state or federal courts located in Hays County, Texas, and you consent to the jurisdiction of such courts.
